This Criminal Misc. Application under section 482 Cr.P.C. has been filed with the prayer to quash the Complaint Case No.2684 of 2012 of 2011 under section 406/420 I.P.C. PS. Moolganj, District Kanpur Nagar and to stay the proceedings of the aforesaid case.
Heard learned counsel for the applicant, learned A.G.A. and perused the record.
Learned counsel for the applicant submitted that in compliance of order dated 17.1.2014, a draft for sum of Rs. 1,00,000/- was deposited. However, the matter has not been referred to the Mediation Centre. Hence, it requires to be referred to the Mediation Centre.
Considered the submission. As per information, the matter has not been referred to the Mediation Centre. Hence, it is negligence on the part of Office as well as Mediation Centre of this Court. Due to delay the validity of the draft has expired.
Let the draft be returned to the applicant through his counsel to get extend its validity. After extension of period of the validity, if the draft is filed, the matter shall be referred to the Mediation Centre of this Court without any further delay.
List on 03.09.2014, with the report of the Mediation Centre, regarding settlement, if any.
Till the next date of listing, interim order, if any, shall continue.
