JUDGMENT / ORDER

1. Rule.
Mr. M.G.Nanavati, learned APP waives service of notice of Rule on behalf of the respondent-state.
2. Heard Ms. S.G.Patel, learned counsel for the applicant-accused and perused the relevant papers annexed with this application including the medical certificate issued by Dr. Shah. As per the certificate, the operation of the wife of the applicant-accused is scheduled on 21.06.2012.
3. In the above view of the matter, the instant application deserves to be partly allowed and the applicant-accused is ordered to be released on temporary bail for a period of two weeks from the date of his actual release on his executing personal bond of Rs. 10,000 (Rupees Ten Thousand only) with one surely of like amount to the sanctification of the concerned jail authority on the condition that during temporary bail, he shall not misuse the liberty, and upon completion of the temporary bail period, he shall immediately surrender to concerned jail.
4. Rule is partly made absolute to the aforesaid extent. Direct service is permitted.
