JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioners, learned Additional Government Advocate as well as Shri Anil Kumar Pandey, Advocate appearing on behalf of opposite party No. 3.
Let counter affidavit be filed by oppsite party No. 3 within six weeks. Rejoinder affidavit, if any, may be filed within next two weeks.
List after expiry of aforesaid period.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 336 of 2010, under Sections 498-A, 323, 504, 506 IPC read with Section 3/4 Dowry Prohibition Act, police station Kotwali Utraula, district Balrampur.
We have gone through the contents of the FIR.
Very outrightly it has been stated by learned counsel for the petitioners that since petitioner No. 2, namely, Abdul Aziz Khan has already been arrested, he does not indent to press this peition on his behalf.
Accordingly, the writ petition is dismissed on behalf of opposite party No. 2.
So far as petitioner Nos. 1 & 3 are concerned, since the allegations levelled in the FIR seem to be trivial in nature, we hereby direct that petitioner Nos. 1 & 3, namely, Azeemuddin Khan and Smt. Nafeesa Begam shall not be arrested in the aforesaid case crime number till submission of charge sheet/police report, provided they cooperate with the investigation, whcih shall go on.
