JUDGMENT / ORDER

Heard learned counsel for the petitioenr and the learned Standing Counsel, who prays for and is allowed four weeks' time to file counter affidavit. Rejoinder affidavit, if any ,may be filed within two weeks' thereafter.
List immediately after expiry of the aforesaid period.
By means of this writ petition, the transfer order dated 23.6.2007 and the relieving order dated 13.6.2010 passed pursuant to that transfer order have been challenged, whereby the petitioner was transferred from Rae Bareli to Lucknow about three years back. It is also submitted that the petitioner has not been relieved till date.
There appears to be no justification or reason to enforce the transfer order after a lapse of 3 years as the transfer orders are passed to meet out the exigencies of service in pursuance of the decision taken at a particular time.
Accordingly, the operation of the impugned relieving order Annexure no. 1 to the writ petition and the transfer order dated 23.6.2007, so far as it relates to the petitioner shall remain stayed with liberty to the opposite parties to pass fresh order to meet out exigencies of service, if necessary.
