Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 3.
The petitioner was appointed as Assistant Teacher (LT grade) on adhoc basis on 01.04.1985. The appointment of the petitioner was approved by the District Inspector of Schools and pursuant to the approval order, he was paid salary from the State Ex- chequer. He retired on 31.03.2019. The GPF was sanctioned to the petitioner by order dated 02.03.2019 which has been paid to the petitioner pursuant to the said order. The petitioner is claiming pension on the strength of the judgement of this Court in the case of Ishrat Jahan Vs. Sate of U.P. & 3 others (Writ A No.5737 of 2018), decided on 07.03.2018. The petitioner in this regard has submitted a representation to the respondent no.1, copy of which is annexed as Annexure 5 to the writ petition.
The grievance of the petitioner is that though he is entitled to pension in view of judgement of this Court in Ishrat Jahan (supra), but the respondent no.1-Deputy Director of Education (Secondary), 1st Region, Meerut has not paid any heed to the representation of the petitioner.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.1 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of with direction to the petitioner to file a fresh representation before the respondent no.1-Deputy Director of Education (Secondary), 1st Region, Meerut raising all his grievances within a period of two weeks from today. In case any such representation is filed, the respondent no.1 shall consider the claim of the petitioner with respect to pension within a period of two months thereafter in the light of the judgement of this Court in Ishrat Jahan (supra).
With the aforesaid observations, the writ petition is disposed off.
