The instant writ petition has been filed seeking quashing of History Sheet No. 131-A, opened against the petitioner at Police Station Sahibabad, District Ghaziabad.
According to learned counsel for the petitioner, opening of the history sheet against the petitioner amounts to gross abuse of the powers under criminal law.
Learned A.G.A submitted that the contention raised by learned counsel for the petitioner can be examined by the second respondent being competent to take appropriate decision.
Having regard to the submission made by learned counsel for the parties, the instant writ petition is disposed of with liberty to the petitioner to file representation raising all his grievances before respondent no. 2 alongwith true attested copy of the instant order and in which event respondent no. 2 shall examine the same and take appropriate decision within next six weeks It is clarified that this court has not expressed any opinion on merits of the case of the petitioner and the decision shall be taken by second respondent without being influenced by any observation made in the instant order.
