Heard Mr. Achyuta Nand Pandey, learned counsel for the applicant and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed challenging the order dated 15.04.2013 passed by Additional Civil Judge IInd (Senior Division)/ Additional Chief Judicial Magistrate, Court no.2, Bulandshahr whereby non-bailable warrant has been issued against the applicant in Complaint Case No. 138 of 2018 (Naurang Vs. Suleman and others) under Sections 323, 504, 506, 392 I.P.C., Police Station- Kakod, District-Bulandshahr.
From the perusal of the record, the Court finds that the applicant was summoned in the above mentioned complaint case vide summoning order dated 07.02.1994. However, as applicant did not appear, the court below passed an order dated 15.04.2013, whereby non-bailable warrant has been issued against the applicant. This order has been in-existence for the last five years and yet the applicant has not appeared before the court below.
In view of the facts stated herein above, no occasion arises for this Court to entertain the present application.
The present application fails and is hereby dismissed.
