The petitioner appeared for High School examination conducted by the Board of High School and Intermediate Examination in the year 2017.
The grievance of the petitioner is that he has not been awarded expected marks in the subject of Maths and Hindi. The Board of High School and Intermediate Examination has provided for a scrutiny system of the answer sheets. The relevant provision of Regulations under the Intermediate Education Act, 1921, is extracted here under:-
"21. (e) सनन्निररीकक्षा कक्षा तक्षात्परर उत्तर पपुस्तककों कक्षा पपुनरररल्रक्षायांकन नहहीं हहै। सनन्निररीकक्षा कक्षारर रम पररीकक्षाररररकों ककी उत्तर पपुस्तककों रम रह ददेखक्षा जक्षारदेगक्षा ककी पररीकक्षारर्थी ककी उत्तर पपुस्तक र क्रक्षा अलग अलग प्रशननो रम नदए गए अयांककों कक्षा रनोग करनदे , उन्हम अगदेनरीत करनदे अरवक्षा नकसरी प्रश्न अरवक्षा उसकदे भक्षाग पर अयांक ददेनक्षा छर टनदे ककी कनोई तपुनट तनो नहहीं हहई हहै । सनन्निररीकक्षा कक्षारर रम पररीकक्षाररररकों ककी उत्तर पपुस्तककों रम पररीकक दक्षारक्षा रल् उत्तरकों कक्षा पपुनरररल्रक्षायांकन नहहीं नकरक्षा जक्षारदेगक्षा । "
रक्षायांनकत प्रशननो क The scrutiny system clearly bars revaluation of the answer sheets. The petitioner had already exercised his remedy of getting his answer sheets scrutinised. No fault can be found on the action of the respondent Board in the scrutiny of the answer sheets. It was done as per the provisions of law. This Court has not the jurisdiction to go any further. It is settled law that a mandamus cannot be issued contrary to the provisions of law.
The writ petition is dismissed.
