JUDGMENT / ORDER

Learned counsel for the petitioner submitted that the petitioner appeared in the High School Examination of 2007. In the marks-sheet, in Hindi First Paper, he has been shown absent while according to the petitioner, he was present and appeared in the examination. In support of the contention, he referred the attendance sheet of the examination, which is at page 34 of the writ petition.
The contention of the petitioner is that immediately after receiving the marks-sheet, he wrote a letter dated 12.7.2007 and further wrote a letter dated 16.3.2009 to the Secretary, Madhyamik Shiksha Parishad but no action has been taken till today.
Sri Ajit Singh, learned counsel appearing on behalf of Secretary, Intermediate Education Board, Allahabad submitted that the attendance sheet reveals that the name of the petitioner has been subsequently inserted. In each individual column, the signature of only one student is mentioned while only in one column there are signatures of two students.
Let the respondents may file counter affidavit within three weeks. Issue notice to respondent no. 4.
List thereafter. It is made clear that in case if the forgery is found in the attendance sheet, the necessary action will be taken against the petitioner and against the person who is responsible for committing the forgery.
