Heard learned counsel for the applicant and learned Additional Government Advocate for the State.
The present application under Section 482 Cr.P.C. has been filed to quash the chargesheet dated 12.2.2019 and cognizance order dated 10.7.2019 passed in Case Crime No.85 of 2018 under Sections 498A, 323, 504 and 506 IPC and Section 3/4 Dowry Prohibition Act, P.S. Deogaon, District Azamgarh, pending in the court of Addl. Chief Judicial Magistrate, Court No.10, Azamgarh.
At the very outset, learned counsel for the applicants submits that there are good chance of mediation between the parties and if one opportunity is given, there is every likelihood that the matrimonial dispute gets resolved resulting in closure/ compounding of the proceedings.
In view of the above and in the interest of justice, the matter is referred to the Mediation and Conciliation Centre of High Court with the direction that same may be tried to be resolved after giving notices to both the parties.
Accordingly, I hereby direct the applicant to deposit a sum of Rs.15,000/- within 25 days from today with the Mediation and Conciliation Centre of this Court and out of the same Rs. 12,000/- shall be paid to the opposite party no.2 on the very first day when she arrives for mediation. Notices will be issued by Mediation and Conciliation Centre fixing date for personal appearance of the parties, however, only after the deposit as directed hereinabove is made. Mediation proceedings shall be concluded in the next three dates of the first appearance of the parties on notice.
Subject to the applicant's depositing the amount of Rs.15,000/- as directed above, further proceedings of the above noted case against the applicant shall be kept in abeyance till the conclusion of mediation proceedings either way. The Mediation and Conciliation Centre, High Court immediately forward the report of conclusion of proceedings and the case be listed within two weeks of the receipt of the report.
In the event of default of deposit as directed above, the interim order shall stand vacated and this application shall also stand dismissed without reference to the Court.
List immediately before appropriate/ regular Court after finalization of the mediation proceedings either way.
