JUDGMENT / ORDER

The petitioner is the accused in C.P. No.215/2013 before the Judicial First Class Magistrate Court, Kasaragod. The offences involved in the said crime are under Sections 323, 294(b) IPC and Section 3(i)(XI) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. 2. The petitioner wants to surrender before the learned Magistrate and apply for regular bail. But he apprehends that he will be remanded to judicial custody in case bail is rejected. In such a situation, he seeks a direction to the learned Magistrate to pass orders on the application for bail, on the date of filing itself.
3. On hearing the learned counsel I find that this petition can be closed with a direction to the learned Magistrate to hear and dispose of the application, if filed by the petitioner, for regular bail, on the date of filing itself, however after giving notice to the learned Public direction that the application for bail, if filed by the petitioner, will have to be heard and disposed of by the court below, on the date of filing itself, however after giving notice to the learned Public Prosecutor.
