Heard learned counsel for the appellant, learned A.G.A. for the State and perused the material on record.
Learned counsel for the appellant has submitted that the parties have compromised the matter between them, which is on the order sheet and the same has been verified by the Registrar General of this Court and the compromise was verified in compliance of the order of this Court dated 02.08.2018.
This appeal is disposed of in terms of the compromise as the parties have entered into compromise and the offence is compoundable within terms of the Code. Earlier, this Court has granted leave to the parties to make a compromise and the parties had entered into compromise, which is annexed in the order sheet and the compromise was verified by the Registrar General vide order dated 09.08.2018.
In view of the compromise, the terms are being accepted and the appeal is allowed in view of the compromise and the impugned judgment and order dated 15.03.2010 passed by the Special Judge( SC/ST Act), Banda in S.T. No.203 of 2003, State Vs. Awadhendra Singh, in Case Crime No.156 of 2002, P.S. Kamasin, District Banda, is set aside.
L.C.R may be transmitted to the concerned court along with this judgment and order.
