Heard Shri Pradeep Kumar Kashyap, learned counsel for the petitioner, Smt. Archana Srivastava, learned counsel for the respondents no.2 & 3 and the learned Standing Counsel for the respondent no.1.
The petitioner is seeking a direction to the respondents to consider his claim for appointment on the post of Technician Grade-II on the basis of equivalent qualification of Post Graduation Diploma in Computer Application issued from the Board of Technical Education, U.P., Lucknow.
According to the petitioner he applied for selection for the post of Technician Grade-II in terms of the Advertisement No.6/VSA/2015/TG-2 dated 24.04.2015 which requires the CCC certificate or a certificate equivalent thereto.
According to the petitioner at the relevant date he has done Post Graduation Diploma in Computer Application from the Board of Technical Education, U.P., Lucknow, certificate of which has been filed at page 18 to the writ petition. He has also obtained a CCC certificate in December, 2016, copy of which has been filed as Annexure-11 to the writ petition.
Smt. Archana Srivastava, learned counsel for the respondents has raised a preliminary objection that the last date of submission of the application form was 17.06.2015 whereas the CCC certificate was obtained by the petitioner in December, 2016 and therefore on the relevant date he was not in possession of the CCC certificate.
This fact prima facie, appears to be correct but the contention of the petitioner is that on the relevant date he was in possession of a Post Graduation Diploma in Computer Application from the Board of Technical Education, U.P., Lucknow, which is equivalent to CCC certificate and therefore, the respondents are required to consider his candidature for appointment on the post of Technician Grade-II on the basis of the certificate of Post Graduation Diploma in Computer Application.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.2, Sachiv, Electricity Service Commission, UP Power Corporation Limited, Lucknow to examine as to whether the certificate of Post Graduation Diploma in Computer Application issued from the Board of Technical Education U.P. is equivalent to CCC certificate for appointment on the post of Technician Grade-II and take appropriate action in accordance with law within a period of two months from the date a certified copy of this order is received in his office.
