Heard learned counsel for the petitioner, learned AGA for the respondents-State and perused the record.
This petition for writ is before us to challenge a notice under Section 3 of the U.P. Control of Goondas Act, 1970. By the notice impugned, the petitioner has been called upon to submit an explanation as to why he be not subjected to an action under sub-Section (3) of Section 3 of the Act of 1970. An explanation too has been filed by the petitioner before the District Magistrate on 16th January, 2018.
In view of the fact that the petitioner has chosen to participate in the proceedings, we do not find any just reason now to interfere with the notice impugned while invoking the powers under Article 226 of the Constitution of India.
The writ petition is dismissed.
