Heard learned counsel for petitioner and learned Standing counsel for the State respondent.
The present writ petition under Article 226 of the Constitution of India has been filed for the following relief:-
"Issue a writ, order or direction in the nature of ceritorari quashing the impugned order of suspension dated 8.9.2020, passed by District Magistrate, Ballia/respondent No. 2(Annexure No. 6 to the writ petition), suspending, the firearm license of the petitioner.
Issue a Writ, order or direction in the nature of mandamus directing the respondent no. 2/District Magistrate, Ballia to decide the matter regarding the suspension of the firearm license of the petitioner by considering the explanation submitted by the petitioner within the some stipulated period."
It is submitted by learned counsel for petitioner that the petitioner does not want to press the first relief as the order of suspension is appealable under Section 18 of Arms Act. It is further submitted that respondent No. 2- District Magistrate, Ballia, may be directed to pass final order after considering the explanation submitted by the petitioner.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and an appropriate direction may be issued to respondent no.2- District Magistrate, Ballia, to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merit of the case and with the consent of the parties, the writ petition is disposed of with a direction to respondent no. 2- District Magistrate, Ballia to decide the matter finally within a period of three months from the date of production of computerized copy of this order.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
The writ petition is disposed of. Order Date :- 5.1.2021/S.K.
