Allegation of the writ petitioner in this public interest litigation is that the teachers beyond the sanctioned strength are working and they are paid their salary. Such a complaint is made in a large number of writ petitions.
In the facts and circumstances of the case, we deem it expedient that the respondents place on record the number of posts created and sanctioned in the District of Balia for payment under the Payment of Salaries Act, 1971. The respondents shall also place on record the number of teachers, who are paid salary from the State exchequer.
The aforesaid affidavit shall be filed and sworned by the Principal Secretary, Department of Secondary Education, Government of Uttar Pradesh.
As prayed for, two months' time is granted to place the same on record.
