Heard the learned counsel for the petitioners, learned A.G.A. and perused the record.
This petition has been filed by the petitioners with a prayer to quash the charge sheet dated 29.6.2017 in connection Special Case No. 165 of 2017 arising out of Case Crime No.146 of 2017 under Section 323, 504, 506 IPC and Section 3(1)(R), 3(1) (S) and 3(2)(5Ka) of S.C/ST Act, Police Station Bardah, District Azamgarh pending in the court of Additional District and Session Judge Court No. 2 Azamgarh.
It is the submission of the learned counsel for the petitioners that the petitioners will regularly appear before the court and will not seek unnecessary adjournments.
Considering the facts and circumstances of the case, it is directed that the proceedings of the above mentioned case shall be expedited and it will be decided within one years, if possible, in the spirit of the provisions of the Act without granting unnecessary adjournment to either of the parties, in case the proceedings are not stayed by any other court.
It is made clear that petitioner shall cooperate in the proceedings before the Court below and shall not misuse this order. In case of any misuse of this order, it will be open for the Court below to pass appropriate orders in accordance with law.
Till then no coercive action shall be taken against the petitioners.
In case this order is not complied with, the court below will be at liberty to pass appropriate order.
