Petitioners are ex-air force personnel, who have been appointed as Assistant Teacher in primary school run by the Department of Basic Education. Grievance is that their services rendered previously with the Central Government are not being taken note of and the benefit of old pension scheme is arbitrarily denied to them. Petitioners have placed reliance upon a Government Order dated 16.9.2011, which apparently supports the petitioners' contention. In respect of such grievance, petitioner has approached the authorities concerned, but no decision has yet been taken. Hence, this petition.
Sri Pankaj Kumar Singh, learned counsel for the District Basic Education Officer, Kanpur Dehat submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioner's claim, noticed above, in accordance with law, by means of a reasoned order to be passed, within a period of three months from the date of presentation of certified copy of this order. Liberty stands reserved to the petitioner to make a comprehensive representation annexing therewith all materials, including government order relied upon to substantiate their claim.
