Heard learned counsel for the petitioner and Shri R.C. Upadhyay for the Gaon Sabha as also learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief:-
"I- Issue a writ order or direction in the nature of mandamus directing the Sub-Divisional Magistrate to decide the case No. 86 of 2012-13 (report Versus Kavita Devi) Under Section 33/39 of U.P.Z.A. and L.R. Act pending in the court of Sub Divisional Magistrate within stipulated time as fix by this Hon'ble Court."
The petitioner who alleges to be the complainant at whose instance proceedings for correction of papers have been instituted against the opposite party is aggrieved on account of the fact that the case for correction of papers instituted in the year 2012-13 has not been decided finally till date.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2/Sub Divisional Magistrate to decide the proceedings as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
