Heard Sri Kamlesh Kumar Yadav, learned counsel for the petitioner and Ms. Tanisha Jahangir Monir, learned counsel for the respondents.
The petitioner is a retired employee of railway and allege that he took a loan of Rs. 7,50,000/- for the purpose of house building. He has already paid the entire amount in November, 2018, but the respondent are not issuing no-dues certificate and are also not returning the sale deed, which was kept by them as security for loan.
The petitioner has filed a representation dated 21.05.2019 raising his above grievance before the respondent no. 1.
Since the matter involves consideration of the factual aspects as to whether the loan amount has been cleared by the petitioner as per terms and condition of loan, we disposed of this writ petition with a direction to the respondent no. 1, to consider and decide the petitioners' representation in accordance with law expeditiously, if possible within six weeks from the date of receipt of copy of this order. In case the contention of the petitioner is found to be genuine and correct, no-dues certificate and sale deed of the petitioner be returned immediately within a period of two weeks thereafter.
With the above observation, the writ petition is disposed of.
