Heard learned counsel for the petitioner and the learned Standing Counsel.
The petitioner who is a Lekhpal has come to be suspended in terms of the order impugned.
The allegation is that on 26 September 2018, the petitioner himself had submitted a report that a Domicile Certificate issued on 15 March 2018 was incorrect since Ritesh, the holder of that certificate was not a resident of Sonbhadra. However, a fresh Domicile Certificate was issue by the petitioner himself on 11 January 2019 favouring Ritesh and showing him to be the resident of same village. This is stated to have come to be issued pursuant to a mistake committed by the petitioner.
Bearing in mind the aforesaid issues of facts which are clearly disputed at this stage and are liable to be enquired into, the Court finds no ground to interfere with the order impugned.
However, on a prayer made by learned counsel for the petitioner, this petition shall stand disposed of with the observation that the respondents shall endeavour to conclude the enquiry proceedings with expedition and preferably within a period two months from the date of presentation of a certified copy of this order. This direction of course shall be subject to the petitioner cooperating in the enquiry proceedings and not taking any unnecessary adjournments.
