By means of this petition, the petitioner seeks issuance of a writ in the nature of certiorari quashing First Information Report bearing FIR No.0074 of 2021, under Sections- 147/148/149/152/307/323/332/336/353/393/435/504/506 IPC & 3/4 Damage to Public Property Act, 1984 & 7 of Criminal Law Amendment Act, 1932, Police Station- Ikauna, District- Shrawasti.
On a bare perusal of the impugned FIR, it cannot be said that no cognizable offence is made out against the petitioner at this stage. Therefore, leaving the factual issues to be investigated, we are not inclined to interfere in the matter. We accordingly dismiss this petition, however, without prejudice to the rights of the petitioner in the pending investigation.
