Awadh Bihari Srivastva vs U.P.Power Corportion ...

High Court Of Judicature at Allahabad|27 January, 2010

JUDGMENT / ORDER

Heard Ms. Jyoti Sikka, learned counsel for the petitioner and Sri S.K.Awasthi for Power Corporation.
It is submitted on behalf of petitioner that the matter was earlier heard and on 17.1.2007 this Court had passed an order that the representation of the petitioner may be decided by the appropriate authority of the U.P. Power Corporation Limited. Accordingly, the representation was filed on 9.2.2007 but the same has not been decided till date.
Petitioner submits that the delay in deciding the representation is not only in defiance of the Court's orders but is also creating undue hardship for the petitioner as his grievance is not being redressed either way. The opposite parties have not chosen to file counter affidavit also in the present case.
Accordingly, this Court considers it fit that the petitioner be given liberty to file fresh representation within ten days from today before the opposite party No.2, who in turn is directed to look into the matter positively and pass speaking and reasoned order within a period of one month from the date a certified copy of this order along with fresh representation including annexures and documents are placed before him.
With these observations the petition is finally disposed of.
Order Date :- 27.1.2010 RKM.
