Petitioner claims that father of the petitioner was initially appointed as Assistant Collection Amin, however, his name was sent for regularization and was actually regularized, however, he could join and unfortunately died on 27.9.2020.
Petitioner claims that after the death of the father of the petitioner, the petitioner has applied for appointment on compassionate grounds. He argues that the question as to whether the persons who are regularized but could not join and died prior to the joining was considered by a Division Bench of this Court in the case of State of UP Vs. Kuldeep Thakur, 2017 (35) LCD 695, 2017 (3) ALJ 97 and followed subsequently in the judgment of this Court in the case of State of UP Vs. Smt. Pushpa Devi, AIRONLINE 2020 ALL 355.
The petitioner claims that in terms of the said judgments, the claim of the petitioner should be considered by the respondent. He claims to have filed representation which is pending consideration before the Respondent No. 3, District Magistrate, Jaunpur.
Considering the submission made at the Bar and the fact that the matter is pending consideration before the Respondent No. 3, District Magistrate, Jaunpur, the present writ petition is disposed off with liberty to the petitioner to file a fresh representation along with a copy of this order. In the event, any such representation is filed, the Respondent No. 3, District Magistrate, Jaunpur shall take a decision in the light of the judgment referred to above as expeditiously as possible preferably within a period of three months from the date of filing of the representation.
Copy of the order downloaded from the official website of this Court shall be treated as certified copy of the order.
