Heard learned counsel for the parties.
This application under Section 482 Cr.P.C. is directed against the order dated 7.1.2019 whereby the application of the applicant dated 27.07.2018 for recalling of an exparte judgment had come to be dismissed in default.
In the opinion of the Court, the proper remedy available to the applicant is to approach the same court for recalling of the order dated 7.1.2019.
This application is accordingly disposed of with the direction that in case the applicant files an application for recalling of the order dated 7.1.2019 before the court concerned, the same may be considered in accordance with law and shall not be dismissed on the ground of delay.
