ORDER:
This Company Petition is filed for ordering winding up of the respondent for non-payment of the debt due to the petitioner.
At the hearing, Sri V.Hari Haran, the learned counsel for the respondent, stated that the entire amount of Rs.1 crore, agreed to be paid by the respondent, was paid to the petitioner.
Smt Manjiri S.Ganu, the learned counsel for the petitioner, stated that the Company Petition may be closed without prejudice to her client’s right to pursue the pending civil suit filed against the respondent.
Sri V.Hari Haran, the learned counsel for the respondent, submitted that his client also may be left with the freedom to defend the civil suit filed by the petitioner.
The above submissions of the learned counsel for both the parties are placed on record and the Company Petition is closed with liberty to both the parties in terms of the prayer made.
