Shri Agendra Sinha, learned counsel for the petitioner and Shri Anurag Verma, learned A.G.A. for the State are present.
The present petition has been filed with the prayer for quashing of the First Information Report No.0813 of 2019, under Sections 323, 406, 419, 420, 467, 468, 471, 506 I.P.C., P.S. Kotwali City, District Hardoi, with a further prayer to stay the arrest during the pendency of the investigation of the said case.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but the police is threatening to arrest the petitioner.
As the petitioner is not named in the F.I.R. and if, the police is visiting his house, then he has to move surrender application before the court below, in which the report will be called by the Magistrate in relation to the involvement of the petitioner, and thereafter, the petitioner will be at liberty to file a fresh one at the appropriate stage.
In view of the same, the present petition is dismissed as not pressed with liberty to the petitioner to file a fresh one at the appropriate stage.
