Supplementary affidavit filed today on behalf of the applicant is taken on record.
Pursuant to the earlier order of this Court dated 25.9.2019 both the applicant (husband) and O.P. No.2(wife) are present before this Court. They have been identified by their respective counsels.
It is contended by learned counsel for the parties that the matter had already been settled between them and in this regard compromise application has been filed which is appended at page 39 of the paper book.
The applicant (husband) undertakes that he will renew the fixed deposit which was deposited before the court concerned where the proceedings under Section 12 of the Protection of Domestic Violence Act is pending and will hand over to the O.P. No.2 (wife) in form of Demand Draft.
In view of the above statement, the entire proceedings of Crl. Case No.564 of 2011 (State Vs. Avinash Sharma) arising out of Case Crime No.0918 of 2010, pending in the Court of C.J.M., Agra under Sections 498 A, 323, 504, 506 I.P.C and 3/4 D.P. Act, Police Station Sadar, District Agra is hereby quashed.
The present application is allowed.
