The petitioner, who is student of B.T.C. Training Course, 2015 having passed first, second and third semester examination, wants to appear in the fourth semester examination, which is to commence from 01.11.2018. However, according to the petitioner, despite his having completed all the formalities, he is not being issued examination form by the Principal and hence the instant writ petition seeking a mandamus commanding the respondents to permit him to appear in the fourth semester examination.
Learned counsel for the petitioner submitted that the petitioner has represented before respondent No. 3 on 16.10.2018, but yet he has not been supplied examination form. It is urged that respondent No. 3 be directed to examine the grievance of the petitioner before commencement of the examination.
Learned Standing Counsel has no objection to the same.
Accordingly, the writ petition is disposed of by directing respondent No. 3 to pass a speaking order within two days from the date of receipt of a certified copy of this order alongwith photo copy of representation (annexure-8). The petitioner shall submit certified copy of this order before respondent no.3 by tomorrow. In case, respondent No. 3 comes to the conclusion that examination form was wrongly withheld, it shall be supplied to the petitioner forthwith, so that he is in a position to appear in the examination. Respondent No. 2, in such a situation, shall take consequential action before start of the examination.
Office is directed to issue the certified copy of this order to the learned counsel for the petitioner on payment of usual charges today itself.
