JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Ms.Shah, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to complete the construction of his house.
It appears from the jail report that the convict was released for construction of the house recently on furlough in the month of August - September, 2011.
Under these circumstances, the discretion does not deserve to be exercised and, therefore, the application is not granted. Rule discharged.
