ORDER:
This writ petition is filed for a Mandamus to set aside proceedings in Rc.No.5966/2013/C dated 15.07.2014 of respondent No.1.
I have heard Mr. K. Jyothi Prasad, learned counsel representing the petitioner, and the learned Assistant Government Pleader for Civil Supplies (A.P.).
By the impugned order, respondent No.1 has suspended the petitioner’s fair price shop authorization pending enquiry. The main grievance of the petitioner is that after suspending his authorization, respondent No.1 has not issued show-cause notice and held enquiry so far.
Considering the fact that the impugned order was passed as far back as 15.07.2014, I find it inappropriate to interfere with the said order at this length of time. However, respondent No.1 is directed to call for explanation from the petitioner, hold an enquiry, wherein he shall give an opportunity of being heard to the petitioner, and pass a final order within one month from the date of receipt of this order.
Subject to the above direction, the writ petition is disposed of.
As a sequel to the disposal of the writ petition, W.P.M.P.No.43529 of 2014 shall stand disposed of as infructuous.
