Heard Sri B.K. Yadav, learned counsel for the appellant and Sri Manoj Mishra, learned counsel for the petitioner- respondent.
This special appeal is reported to be delayed by two years and six days. The Writ Petition No.44973 of 2004 ( Kali Charan pandey Vs. State of U.P. and others) , filed by the petitioner, was allowed by the learned Single Judge vide judgment and order dated 12.5.2008 and thereafter impleadment application filed by the present appellant was also rejected on 17.5.2010 In view of the facts and circumstances of the case, we are not satisfied that any ground is made out for our interference against the order passed by the learned Single Judge.
In our view, there is no merit in the appeal Appeal dismissed.
