Heard learned counsel for the petitioner; learned AGA for the respondents 1 to 4 and perused the record.
The instant petition seeks quashing of the notice dated 28.03.2019 issued under Section 3 (1) of U.P. Control of Goondas Act, 1970.
Learned counsel for the petitioner has sought to argue that the notice does not disclose the necessary ingredients on the basis of which it could be held that the petitioner is a Goonda.
We have perused the notice.
From a perusal of the notice, it cannot be said that the notice suffers from any fundamental defect.
In so far as the merits of the allegations in the notice are concerned that can be addressed by the petitioner in his reply to the notice.
In view of the above, we decline to quash the notice and leave it open to the petitioner to submit his response to the notice.
