(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Grievance of the applicant was that despite orders from the court, respondent No.1 Municipality was not taking sufficient steps to remove the unauthorized construction of respondent Nos.3 and 4.
On behalf of respondent No.1, an affidavit has been filed today in which it is stated that nearly 70% of the demolition work is over and 30% of the offending structure only stands which demolition work shall be completed within 5 to 6 days. In addition to the above affidavit, counsel for the respondent also showed us photographs of the building in question before and after demolition. We are convinced that the Municipality is taking sufficient steps to implement court's order. We do not find any reason to survive this petition any longer. Same is therefore disposed of with liberty to apply in case of difficulty.
