Heard learned counsel for the petitioner; learned Standing Counsel for the State respondent nos.1 to 3 and Shri Manu Singh, learned counsel appearing for the Land Management Committee.
The petitioner is before this Court with request to issue direction to the Sub Divisional Magistrate, Tehsil Aliganj, District Etah to decide the Case No.22 of 2009 (Mahaveer Prasad vs. Bhagwan Swaroop and others) within stipulated time.
Learned Standing Counsel fairly states that in case the aforesaid case is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the respondent no.3 to consider and decide petitioner's aforesaid case by a speaking order after affording opportunity of hearing to all the stake holders within a period of three months from the date of production of a certified copy of this order before him.
