Heard learned counsel for petitioners and learned A.G.A. for the State.
The counsel for petitioners states that it is a matrimonial dispute and prays that the matter may be referred to the Mediation Centre.
It is directed that petitioners shall deposit a sum of Rs.8,000/- within a period of three weeks from today with Mediation and Conciliation Centre. Out of the amount so deposited, respondent no.2 shall be given money for her to and fro journey on producing a certificate of the expenditure.
Let this order be placed before the Registrar/ Incharge of 'Allahabad High Court Mediation and Conciliation Centre'. The Registrar/ Incharge of Mediation Centre shall fix a date and every efforts shall be made for re-conciliation and complete the process of mediation within three months from today. In the event effort is not successful, the case will be listed after three months along with report of conciliator.
Till the next date of listing, operation of the impugned order dated 30.6.2009 passed by learned Sessions Judge Deoria, in Session Trial No.48 of 2008 State Vs. Atul Kumar and four others arising out of case crime no.743 of 2006 under Sections 498-A, 307 I.P.C. and 3/4 Dowry Prohibition Act, Police Station Kotwali Deoria, District Deoria, shall remain stayed.
