1. The record shows that by order dated 30.10.2012 this Court (Coram:Hon ble Smt.Justice Abhilasha Kumari) was pleased to admit the matter and passed following order:-
Admit.
The petition be fixed for final hearing on 18.12.2012. The admission of the petition and the date of final hearing shall be published in two local daily newspapers, that is, the English Daily newspaper Indian Express and the Gujarati daily newspaper Jansatta, both Ahmedabad editions. Publication in the Government Gazette is dispensed with.
2. Mr.Digant M. Popat, learned counsel for the petitioner states that in fact the advertisement has been published in English daily newspaper Indian Express as well as Gujarati daily Newspaper Jansatta both Ahmedabad editions. As per the order dated 30.10.2012, the notice was given that the petition shall be listed on 18.12.2012. However, due to inadvertence, instead of mentioning Company Petition No.189 of 2012 in the advertisement which is so published, it is mentioned as Company Petition No.89 of 2012.
In opinion of this Court, the same is not published appropriately, as required under the Companies Rules applicable, hence, the petitioner shall give either fresh advertisement or advertisement in form of corrigendum in English daily newspaper Indian Express as well as Gujarati daily Newspaper Jansatta , both Ahmedabad editions.
The petitioner shall file appropriate affidavit of compliance of order dated 30.10.2012 .
