Rejoinder affidavit filed by learned counsel for the applicant is taken on record.
Heard Sri Arun Kumar Pandey, learned counsel for the applicant and Sri Qazi Vakil Ahmad, learned counsel for the opposite party nos.2 & 3.
The present application for transfer of Case No.302 of 2013 (Shweta Gupta and others Vs. Atul Agrawal), under Section 125 Cr.P.C., has been moved by husband feeling aggrieved with the then Presiding Officer of Family Court, Kanpur Nagar.
Parties' counsel submits that the then Presiding Officer of Family Court, Kanpur Nagar has been transferred in March, 2018 during annual transfers so the transfer application may be dismissed as infructuous. However, the parties are ready to negotiate for which the trial court may refer the matter for a limited period to the Mediation and Re-conciliation Centre.
In view of submissions made by learned counsel for the parties, the transfer application is disposed of with the direction to the Principal Judge, Family Court, Kanpur Nagar to provide one more opportunity to the parties for negotiating for the purpose of re-conciliation and re-union between them for a limited period of one month which time shall not be extended beyond two months in total. After mediation the trial court will proceed in accordance with law.
