JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V.NAGARJUNA REDDY Writ Petition No.33929 of 2014 Between:
Atukuri Siva Kumari And Dated 17th November, 2014 …Petitioner The State of Andhra Pradesh, rep.by its Principal Secretary, Civil Supplies Department, Secretariat, Hyderabad and others …Respondents Counsel for the petitioner: Sri P.S.P.Suresh Kumar Counsel for the respondents: GP for Civil Supplies (AP) The Court made the following:
ORDER:
This writ petition is filed to set aside proceeding bearing Rc.No.1733/2014-B, dated 03.11.2014, of respondent No.3, whereby he has suspended the petitioner’s fair price shop authorisation.
This Court by order, dated 13.11.2014, directed respondent No.3 to be personally present in order to meet the averments of the petitioner that if the column relating to the quantity of kerosene is properly filled against the names of the cardholders who have already signed or affixed thumb impressions, the quantity of 108 litres allegedly found short fall will tally.
Today, at the hearing, respondent No.3 is personally present. He has stated that in view of serious complaints given by many cardholders that the petitioner has forged their signatures/thumb impressions in the registers as if the kerosene was distributed, the petitioner’s authorisation was suspended.
Sri P.S.P.Suresh Kumar, learned counsel for the petitioner, has seriously disputed this allegation.
Considering the fact that the enquiry is pending before respondent No.3, I refrain from rendering any finding on this disputed issue. Respondent No.3 is therefore directed to complete the enquiry, wherein he shall give a fair opportunity to the petitioner to represent her case, and pass a final order within three weeks from the date of receipt of a copy of this order.
Subject to the above direction, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.42453 of 2014 shall stand disposed of as infructuous.
