JUDGMENT / ORDER

Mr. BC Rupera, Ld.
Advocate for the applicants, under instructions, submits that at this stage he is not pressing this quashing petition. However, he requested that the charge-sheet being Criminal Case No. 45/2010, so also Criminal Case No. 1148/2009 should be tried by any one Ld. Metropolitan Magistrate simultaneously.
Mr. Dave, Ld. Advocate for the respondent no. 2 and Mr. Raval, Ld. APP for the respondent no. 1 have no objection if both the cases are to be tried in one Court simultaneously.
In above view of the matter, the instant application stands disposed of with direction that Criminal Case No. 45/2010 and Criminal Case No. 1148/2009 shall be tried and decided by any one competent Court of the Metropolitan Magistrate Courts, Ahmedabad.
The above order is passed without examining any merits of the matter. Notice is discharged. DSP.
