The respondents are granted one month's time for filing counter affidavit.
Rejoinder affidavit may be filed within three weeks thereafter. List in 1st week of July, 2018.
The counsel for the petitioner submits that punishment has been awarded to the petitioner in the year 2010, while the promotion was made in December, 2016. The effect of punishment was five years and it has been considered at the time of promotion. Now without any material, Accountant had noted that effect of punishment was up to 2020, which is contrary to the circular of corporation and on that basis the promotion of the petitioner has been cancelled without giving opportunity of hearing.
The matter requires consideration.
Till the next date of listing, operation of the order dated 16.3.2018 shall remain stayed.
