JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) TUESDAY, THE SEVENTH DAY OF OCTOBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.27658 of 2014 BETWEEN M/s.Atlas Offshore Services Pvt. Ltd., Rep. by its Promoter and Managing Director AND ... PETITIONER The Director General of Police, Government of Andhra Pradesh, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner complains of inaction on the part of the respondents in completing the investigation with respect to F.I.R.No.310 of 2013, dated 23.12.2013 filed before respondent No.4. It is alleged that respondent No.4 is also not taking action on the petitioner’s representation, dated 08.08.2014, to expeditiously complete the investigation.
3. Learned Government Pleader has received instructions from respondent No.4, which state that after registering the said F.I.R., investigation was taken up and during the course of investigation, complainant and three other witnesses were examined. However, none of the witnesses appear to have supported the version of the complainant/petitioner. The instructions further state that since the investigation reveal that the dispute is civil in nature, appropriate requisition before the Assistant Commissioner of Police, East Sub-Division, Visakhapatnam was sought and as per permission granted by the Assistant Commissioner of Police, respondent No.4 was permitted to refer the case as civil in nature. Hence, it is stated that after serving the notice on the complainant, final report would be submitted before the jurisdictional court at the earliest.
4. Since the investigation is already completed as per the instructions noted above, no further orders are necessary in the present writ petition.
Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
