Written instruction supplied by learned counsel for the respondent is taken on record.
The petitioner seeks to challenge the transfer order dated 12.07.2019 whereby he has been posted in District Kasganj and at the time of transfer, the petitioner was posted in District Aligarh.
On the instruction, it is informed by learned counsel for the respondent-department that the petitioner is working on the post of Office Executive and senior Class-III employees cannot be kept in their home district. The petitioner being native of District Aligarh has been sent to District Kasganj in terms of the clause 3(ii) of the transfer policy dated 03.06.2019.
It is noteworthy that only submission made by the petitioner to challenge the transfer order is that he cannot be posted out of the District as he has not completed ten years of maximum service in one District.
This stand has been based on clause 3 (ii) of the transfer order as aforesaid is not entertainable for exclusion in the same clause for those employees who are posted in their home District.
No interference is, thus, required in the transfer order.
The writ petition is found devoid of merits and hence dismissed.
