JUDGMENT / ORDER

Petition filed under Section 438 Cr.P.C. 2. Petitioners are A6 to A9 in Crime No.539 of 2014 of Central Police Station, Ernakulam, registered for the offences punishable under Sections 143, 147, 148, 323, 324 and 307 r/w 149 IPC.
3. The allegation against the petitioners and other accused is that on 20.03.2014, at 1.50pm, they along with the other accused formed themselves into an unlawful assembly, committed rioting, and rioting armed with deadly weapons like knife, iron rod, iron chain etc. and voluntarily caused hurt and attempted to commit the murder of the defacto complainant and others.
4. Heard the learned counsel for the petitioners and the learned Public Prosecutor.

5. The learned Public Prosecutor has pointed out that A6, A7 and A9 have other criminal antecedents on their part. It seems that petitioners had earlier moved this Court for anticipatory bail through B.A No.2651 of 2014 and the same was dismissed by order dated 22.05.2014. There is absolutely no change of circumstance at all, as far as the petitioners and the present case is concerned. The investigation of the case is not over. It is not a fit case wherein anticipatory bail can be granted to the petitioners.
In the result, this bail application is dismissed.
