JUDGMENT / ORDER

This petition is filed by the accused and the defacto complainant in Crime No.277/2013 of Ambalavayal Police Station, Wayanad District.
2. Crime was registered against the 1st petitioner alleging offence under section 376 of IPC. It is stated that, in fact, the 1st petitioner and 2nd petitioner were in love and they were living together. In view of the relationship between the accused and the complainant (petitioners 1 and 2), the 2nd petitioner (girl) was sent out of her house and she has been actually staying with the 1st petitioner in his house.
3. The learned Public Prosecutor also submits that the complainant is staying with the 1st petitioner in his house as his wife. It is reported that they are happily living Crl.M.C. No. 2701/2014 -2-
as husband and wife. But it is seen that no marriage, as such, was registered since the 1st petitioner has not attained 21 years. But a formal marriage ceremony was conducted from the temple, it is stated.
3. Since the petitioners are living together happily as husband and wife, I think that further proceedings in this crime has to be quashed as otherwise that will affect the future of the girl and the petitioner as well. Hence further proceedings in Crime No.277/2013 of Ambalavayal Police Station, Wayanad District, is quashed.
