This writ petition has been filed, for issuance of a writ of Mandamus, directing the respondents to measure the petitioner's house site in Old S.F.No.30/1 and New S.F.No.30/10, at Ammapatty Village, Pudukkottai District by considering the petitioner's representation dated 06.03.2017.
2.According to the petitioner, the land referred supra is the ancestral property of the petitioner and to protect his land and also to fence the house site, he wanted to survey the land. Hence, on 06.03.2017, he submitted a representation to 1st respondent to measure the property along with challan, showing payment of fees. Since no action was taken, the present writ petition has been filed.
3.In the counter filed by the second respondent at paragraph 4, it is admitted that the petitioner has paid necessary fees and also produced necessary challan to measure the land in Old S.F.No.30/1 and New S.F.No.30/10, in Ammapatty Village, Pudukkottai District.
4.Mr.M.Ramu, the learned counsel appearing for the petitioner would submit that the petitioner would be satisfied if the respondents are directed to measure the property as per the representation dated 06.03.2017, for which the learned Special Government Pleader has no objection. The learned counsel for the petitioner also would submit that co-pattadhars have no objection to measure the property and they have also given no objection letter to measure the property.
5.Considering the above fact, the first respondent is directed to survey the land of the petitioner, namely, Old S.F.No.30/1 and New S.F.No.30/10, in Ammapatty Village, Pudukkottai District as per his representation dated 06.03.2017, as expeditiously as possible, preferably within a period of eight weeks from the date of receipt of a copy of this order.
6.Accordingly, this Writ Petition is disposed of. No costs.
