THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.28362 of 2014 ORDER :
The petitioner claims to have purchased Ac.7-05 cents of land in Survey Nos.102/1, 102/2C and 102/2A of Dharanikota Village, Amaravathi Mandal, Guntur District, from Saripudi Dasaratharamaiah on 28.06.2003. The petitioner claims that Saripudi Dasaratharamaiah, succeeded to the above property which was settled between three persons in equal shares. However, another person by name Madhusudhana Rao, who also acquired equal share, was trying to alienate the land more than what he is entitled to i.e., 7.05 cents including the land purchased by the petitioner on 28.06.2003. In the circumstances, in order to ascertain the boundaries, the petitioner claimed to have applied for conducting survey on 08.04.2013 to the 3rd respondent. The petitioner also sent reminder on 26.06.2014. However, so far no action is taken as requested by the petitioner. Hence, this writ petition.
2. Having regard to the submission made that the application submitted by the petitioner on 08.04.2013 and subsequent reminders have not so far acted upon, without expressing any opinion on merits, the writ petition is disposed of directing the 3rd respondent to pass appropriate orders on the representation dated 08.04.2013 and 26.06.2014, within a period of three weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
4. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
