1. RULE.

2. The petitioner has sought modification of the conditions of bail granted by order dated 27.10.2010 in Criminal Misc. Application No.13014 of 2010. According to the petition, the petitioner is having his family and joint family property, including agricultural land, at village Aligad, Dist. Taunk in the State of Rajasthan and he is required to stay there for nearly six months for taking necessary care of the land and the family. Learned Special Public Prosecutor submitted that no incident of violation of any of the conditions of bail is reported against the petitioner. However, if and when the conditions were to be modified, stricter conditions were required to be imposed to secure the petitioner's presence at the time of hearing of the appeal, which is pending.

Having heard learned counsel Mr.K.G.Shaikh and considering the facts and circumstances, the conditions contained in para 5 (a) of the order dated 27.10.2010 in Cri.M.A. No.13014 of 2010 is modified to the extent that, for the period from 15.05.2012 to 16.11.2012, the petitioner is permitted to travel to his village in District Taunk in Rajasthan, after furnishing to the police station concerned the date and route of travel and permanent address within the district of Taunk, Rajasthan. It is submitted and therefore stipulated that the personal bond and surety furnished by the petitioner as also all other conditions of bail shall continue to operate during the aforesaid period, with the exception that he will not be required to mark his presence before the police station concerned during the aforesaid period. Rule is made absolute accordingly. Direct service today.
