Chandrashekaraiah, HCGP for R1) This Criminal Petition is filed under Section 482 of Cr.P.C praying to quash the entire proceedings initiated by the 1st respondent on the basis of the 2nd respondent complaint pending on the file of the Court of 2 Senior Civil Judge and JMFC at Nagamangala in C.C.No.421/2015 for the offences P/U/S 417 and 420 of IPC.
This Criminal Petition coming on for Admission, this day, the Court made the following:
ORDER Counsel for the petitioner seeks leave of this Court to withdraw the petition with liberty to urge the same grounds in the trial Court by filing appropriate application.
Memo is placed on record. Liberty as sought for, is granted.
Hence, petition is dismissed as withdrawn.
In view of dismissal of main petition, IA.No.1/2017 does not survive for consideration. Accordingly, IA.No.1/2017 is dismissed.
