This is a second bail application moved on behalf of appellant praying to enlarge the appellant on bail in S.T. No. 235 of 2013, (State vs. Atar Singh and another) in Case Crime No.96 of 2013, under Section 302 I.P.C., Police Station-Aadampur, District-J.P. Nagar.
Heard learned counsel for the applicant and learned AGA for the State.
This is the second bail application filed on behalf of the appellant Atar Singh. The first bail application of the appellant was dismissed for want of prosecution, by this Court vide order dated 13.2.2018 We have perused the order by means of which co-accused Ram Prakash has been already enlarged on bail vide order dated 13.02.2018 in Criminal Appeal No. 203 of 2017. The record shows that Tamancha has been recovered from the possession of the present applicant Atar Singh. It has further been transpired from the record that specific role of fire has been assigned to the accused-appellant.
However, looking to the fact, no case for grant of any indulgence has been made out.
Accordingly, the application for bail is rejected.
